Arrestee escorted to jail on foot due to smelly problem

March 11, 2018

Woods County Undersheriff Keith Dale encountered an odorous problem Friday afternoon, March 2, in Alva.

According to court records, Woods County Dispatch sent Dale to the alley behind the 400 block of Center Street about 2:40 p.m. He was asked to check on a report of an intoxicated man sitting in a vehicle. Dale found Cort Ryan Cunningham, whom he recognized from a previous encounter, sitting in the backseat of a broken down Chevrolet Tahoe.

Dale opened the back passenger side door and immediately smelled the odor of an alcoholic beverage. He spoke with Cunningham, who had thick slurred speech. Dale asked Cunningham what he had consumed, and Cunningham stated, “I’m drunk,” according to the affidavit.

When Cunningham exited the vehicle, Dale observed he was very unsteady on his feet and had lethargic movements. He saw that Cunningham’s clothing was disheveled with his pants undone. Dale could smell the odor of feces emitting from his person.

According to the affidavit, Dale found a plastic coffee container immediately outside the vehicle on the ground. Inside he found a metal pipe with burnt marijuana residue, loose marijuana and two jewelers’ style baggies. He also observed a pile of human feces near the rear of the vehicle.

Dale placed Cunningham under arrest. Due to Cunningham having human feces on his person, Dale escorted him on foot to the Woods County Sheriff’s Office to complete the book in process.

Cort Ryan Cunningham, 20, of Alva has been charged with two misdemeanor counts in Woods County: (1) unlawful possession of drug paraphernalia and (2) public intoxication.
