Two charged after reportedly shooting gun on private property

 


Two men were arrested after someone reported they were shooting a gun on private property without the owner’s consent.

According to court documents, on May 23 about 5:45 p.m. Woods County Undersheriff Keith Dale reported receiving a call about individuals shooting a gun about a half mile west of US-281 on Hughes Road. At that point Hughes Road dead-ends and turns into a private access. The reporting party said the two individuals were in a silver car.

Dale arrived and made contact with Tyler Detgen and Nicholas Vanlandingham. Deputy David Cummings arrived and saw the men standing near a silver car which was registered to Vanlandingham. Dale had the firearm the two were allegedly discharging, a Kimber .380 handgun. The gun was later seized for safekeeping until Detgen made arrangements to get it returned.

Cummings noted in his affidavit that both Detgen and Vanlandingham have criminal records for drug possession. Dale asked for consent to search their vehicle, but they declined. The Alva Police Department was called to bring a K-9. Officer Kris Franta and K-9 “Gater” arrived within a few minutes. The canine gave a positive alert when taken around the vehicle.

A search of the vehicle revealed a “dugout” or metal tube was found in the driver side door. It was found to contain a grinder with a green leafy substance and an odor of marijuana. The other end of the dugout contained the storage side with a “one-hitter” style pipe with burnt residue. On the passenger side in the floorboard, officers reported finding a green plastic container labeled “West Edison” and “Cannabis Concentrates.” It was found to contain a green leafy substance with the odor of marijuana.

Both men were placed under arrest and transported to the Woods County Jail to be booked and jailed.

Nicholas Brad Vanlandingham, 33, of Cherokee, and Tyler Cody Detgetn 31, of Alva, were each charged with three misdemeanors: (1) possession of controlled dangerous substance (marijuana), (2) unlawful possession of drug paraphernalia, and (3) trespassing on private property.
