Alva man charged with child neglect

An Alva man has been charged with two counts of felony child neglect. In both cases, the child talked to adults who then contacted police.

On Oct. 12 and Oct. 13, James Curtis Shramek, 39, of Alva was charged with counts of felony child neglect. This crime is punishable by imprisonment in the custody of the Department of Corrections not exceeding life imprisonment, or by imprisonment in a county jail not exceeding one year or by a fine of not less than $500 nor more than $5,000 or both such fine and imprisonment. Shramek posted an appearance bond. His next court date is Nov. 14.

According to court records, the first incident was reported on Oct. 1 when Alva Police Officer John Caviness was dispatched to an Alva address to investigate possible child neglect. He was met by an adult woman and a girl, age 8. Caviness states that he has had past contact with the woman and her boyfriend Shramek.

The woman said she entered the residence and removed the child. She said the girl contacted her and told her that Shramek was “high” on narcotics. Caviness went inside were he saw Shramek asleep in the bedroom. After several attempts, he was able to wake Shramek.

Caviness states he observed that Shramek had slow raspy speech, depressed reflexes, drowsiness and droopy eyelids. He asked Shramek to stand so he could look at the pupils of his eyes, which he noted were constricted.

Officer Caviness asked Shramek is he had taken any illegal substances, and Shramek said he had not taken any pain pills. He said he had taken “Suboxone,” used to relieve pain and aid in addiction to narcotic pain relievers. He retrieved a box of the medication with his name and address on it. He said he had taken two dosages. He said he felt tired but not impaired.

Caviness administered some field tests to determine impairment. He asked Shramek what day it was, and he correctly said Sunday. However, when asked the month and year, he said Sept. 2 or 3. The date was Oct. 1.

The officer again spoke with the woman who had taken custody of the girl. She told Caviness she believed Shramek had gone to Wichita and possibly made an illegal purchase of Xanax, which she believed was in his residence.

The child wrote out a statement describing Shramek as falling on tables and passing out as well as making threats against her mother. The child stayed with her mother for the rest of the night.

The second incident occurred on Oct. 11. Alva Police Officer Timothy Clapp was contacted about 8:45 a.m. by a teacher at Longfellow Elementary School. She said a student told her she had found drugs at home, hid them in her sock and brought them to school.

Clapp talked to the teacher who said the girl told her she was getting out of the bath and found a plastic wrapper containing pills under her towel. She hid them in her sock, took them to school and told her teacher because she didn’t know what to do.

Clapp then talked to the girl who told him the same thing. She said she did not want her dad, Shramek, to take the pills.

Clapp took possession of the five pills, which were identified as Alprazolam .25 mg, a schedule 4 drug used for anxiety, depression and panic disorder. According to Oklahoma PMP Aware there has been no prescription filled for Alprazolam from 10/11/2016 to 10/11/2017 for Shramek.

Court paperwork notes that Shramek has a known history of drug abuse including charges for DUI alcohol or drugs and possession of drugs and paraphernalia.
