Women charged with letting minor smoke marijuana

Two Alva women are facing charges in Woods County for allegedly allowing a minor to smoke marijuana.

According to court records, Alva Police Officer William Shahan went to the Sandpiper Apartments at 6:40 p.m. on Wednesday, Feb. 7, about a parking complaint. The owner of the apartments wanted a vehicle moved because it was parked in another resident’s spot. Shahan explained it was private property, and the owner would have to contact a wrecker to have the vehicle removed.

The owner said he thought the vehicle’s driver might be visiting at a specific apartment and asked Shahan to check as he didn’t want to have the vehicle towed.

When Shahan approached the apartment door, he could smell a strong odor of burnt marijuana. He contacted Woods County Deputy Adam Honeyman to assist him. After Honeyman arrived, Shahan made contact with Laine Marie Shillito inside the apartment. Shillito identified the vehicle as belonging to her friend Amy. She said Amy was not in the apartment but left to take her children to see the children’s father who was at work. Shahan asked who was smoking weed in the apartment, and Shillito said no one was smoking weed.

Shahan explained he could smell it, and said he knew someone was or had been smoking weed. Shillito said the kids had smoked in the bathroom earlier before they left. Shahan detained Shillito, placing her in handcuffs. He asked Honeyman to check if anyone else was inside the apartment.

When Honeyman went into the bedroom he found Amy Lynn Webb sitting on the bed. Shahan also detained her, placing her in handcuffs. He asked more officers to assist.

After the officers arrived, Shahan spoke with Undersheriff Keith Dale about the situation. They read Shillito and Webb their Miranda rights. Webb invoked hers to remain silent. Shillito waived her rights and agreed to speak with them.

According to the affidavit, Shillito told the officers Webb’s daughter, age 17, had smoked marijuana in the bathroom. Shillito said she provided a paperclip to use with the marijuana pipe. Paperclips are commonly used to poke or stir the marijuana in pipes.

Dale asked Shillito for consent to search the apartment, and she said she would give them what she had. She said she had a meth pipe that had been left in the apartment, retrieved it and gave it to them. The glass pipe had a white residue and field tested positive for methamphetamine. Shillito said she was holding the pipe for someone else who had smoked meth in her bathroom the previous week.

Then Webb’s juvenile daughter returned to the apartment. She was read her Miranda rights and chose not to speak to the officers. However, Webb asked to speak with her daughter, and the juvenile then agreed to talk. She said she had marijuana and a pipe inside her purse, retrieved it and gave it to Officer Shahan.

Webb said there was a marijuana pipe shoved between the wall and the bed. Shahan and Dale spoke with Shillito who signed a written consent to search form. The officer located the pipe with burnt marijuana residue between the bed and the wall. The juvenile was released to her father.

Laine Marie Shillito, 36, of Alva has been charged with maintaining a place for keeping/selling controlled substance, a felony. This crime is punishable by a fine of not more than $10,000 and/or county jail imprisonment not more than five years and costs. Shillito has also been charged with two misdemeanors: contributing to the delinquency of minors (allowing minor to smoke marijuana in apartment) and obstructing an officer (telling officer the apartment was unoccupied).

Amy Lynn Webb, 38, of Alva has been charged with child neglect, a felony. This crime is punishable by imprisonment in the custody of the Department of Corrections not exceeding life imprisonment, or by imprisonment in a county jail not exceeding one year, or by a fine of not less than $500 nor more than $5,000, or both such fine and imprisonment.
