Man charged with domestic assault

An Alva man has been charged with domestic assault and battery after a woman sought emergency room treatment.

According to court records, on April 9 Woods County Undersheriff Keith Dale was asked by an Alva police officer to come to Share Medical Center to take the report on the incident which occurred in a rural part of the county.

Dale spoke with Katy Dalene Ryals who said about 10 p.m. on Sunday, April 9, she and her boyfriend Mikel Aaron Gibson were at a friend’s house near Dacoma drinking beer and dancing. Ryals said they became intoxicated and began to fight about Gibson dancing with other women so they left.

Ryals said the fight continued as they drove west on Craig Road. She attempted to call a friend to come get her, but she said Gibson “blew up” and grabbed her iPhone, throwing it out the window along with her hat. Ryals said Gibson began pulling her hair and sticking his fingers in her mouth and down her throat.

She said Gibson turned south on County Road 460 where he began to drive at a high rate of speed; Ryals asked him to stop and let her go. Ryals said she was able to get the vehicle in park, removed the keys from the ignition and threw them in the ditch. She then began to walk away.

She said Gibson was on his phone calling someone to come pick them up when he pulled her hair and knocked her to the ground and sat on top of her while she was lying on her back. Ryals stated Gibson slammed her head into the ground several times. She said during the fight Gibson drove the right side of her face into the ground, covered her mouth with his hand and pinched her nose to interfere with her breathing. She said he again placed his fingers in her mouth, which she bit in self-defense.

Ryals said when she began to scream, Gibson got off of her. She said she was lying in the ditch when their friend John Maul arrived and separated them for the night. Ryals said her friends would not let her call law enforcement because everyone was intoxicated. She said Gibson had beaten her up in the past where law enforcement was involved.

Ryals told Dale as a result of the fight her face was swollen, she could not open her mouth all the way, she was missing hair on her head and she had scratches on her back.

Dale learned that on Sunday, April 8, about 11:45 p.m. Woods County Deputy Adam Honeyman received a report of an abandoned vehicle about a half mile south of the intersection of Craig Road and County Road 460 where Ryals said the assault occurred. Honeyman reported the 2017 GMC pickup was parked in the middle of the roadway and no keys were located. The vehicle was towed.

About noon on Monday, Dale went to the location where he located GMC pickup keys in the ditch and a Hooey brand hat in a wheat field.

About 1:07 p.m. Monday, Dale located Gibson who provided a story similar to Ryals. Dale placed Gibson under arrest and booked him into the Woods County Jail.

Dale spoke with Maul on Tuesday. He said when he located Ryals and Gibson Sunday night, she was lying in the ditch holding clumps of her hair while Gibson was standing upright.

Dale obtained medical records from Share showing Ryals sustained several injuries including injuries to the inside of her mouth near her throat and bruising to her scalp.

On April 10 Ryals sought additional treatment at Share for her injuries. She was having difficulty breathing which was attributed to bruising on her left rib cage and problems in her lungs from not being able to fully inhale. She was diagnosed with a contusion on her left side ribs, acute facial pain and abrasion of her back.

Mikel Aaron Gibson, 24, of Alva has been charged with domestic assault and battery by strangulation, a felony. This crime is punishable by not less than one year nor more than three years, or by a fine of $3,000 or both. His bond was set at $5,000 and his next appearance in court is set for May 8.
