Three arrested on drug charges, one escapes on foot

Two officers went to an Alva address to serve an arrest warrant. Although the man with the arrest warrant managed to escape, three others were arrested on drug charges.

On Oct. 10 Woods County Associate District Judge Mickey Hadwiger issued a felony arrest warrant to Justin Dean McClary in case CF-2015-107 possession of a controlled dangerous substance (Oxycodone). McClary’s address was listed as 1113 Barnes in Alva.

On Nov. 6 at 4:45 p.m. Alva Police Officers John Caviness and Keith Dale went to the address to serve the warrant. Dale went to the front door to knock while Caviness went to the back of the residence in case anyone tried to flee. As Dale knocked on the door, he saw someone look through the front door curtain and lock the door. He then heard several people inside running.

A short time later Caviness reported he had three people detained in the backyard. Dale went to the backyard where he recognized Logan Kyle McClary. He could smell the odor of marijuana coming from the three individuals. Dale asked Logan where Justin was, and he said Justin was inside.

After detaining the three, the officers entered the residence through the open back door to arrest Justin. Dale saw Justin walk into a bedroom on the west end of the residence. He instructed Justin to stop which he did. Caviness ordered Justin to lie on the ground which he did. Dale told him he was under arrest for a felony warrant. Dale reports that Justin became angry and attempted to get up.

Since the officers had used all their handcuffs on the other three individuals, they placed Justin in an escort position and instructed him to stand up. When Justin stood, he attempted to pull away from the officers. He lunged toward Dale who attempted to take him to the ground to regain control. The officers said Justin began aggressively fighting them, striking both of them in the head and body with his closed fists and elbows.

According to the officers, Justin then ran out of the bedroom and into the garage where he was able to escape through an exterior door and flee on foot. In a Facebook posting, the Woods County Sheriff’s Office described McClary was wearing athletic shorts and no shirt or shoes. At last report, Justin McClary was still at large. Anyone with information on his whereabouts is asked to contact Woods County Dispatch at 580-327-6991.

While the officers were trying to arrest Justin McClary, they noticed drug paraphernalia and marijuana inside the residence. Based on this, the officers placed Logan McClary, Austin William Hofer and Joy Nichelle Fife under arrest. They were taken to the Woods County Sheriff’s Office for booking.

The officers then obtained a search warrant for the residence and executed that at 6:30 p.m. Among items found at the residence were:

• $224 in currency.

• A black iPhone.

• A shoe box containing a sandwich baggie of about 20.6 grams of methamphetamine, a jewelers baggie with about .56 grams of meth, and another jewelers baggie with about 1.28 grams of meth.

• A glass smoking pipe with residue.

• A Palmscale digital scale with residue.

• A Triton digital scale with residue.

• A mason jar labeled “Big Medicine Cannabissary” containing marijuana residue.

• A mason jar containing four packages of marijuana weighing approximately .047 oz., .052 oz., .053 oz. and .052 oz.

• A mason jar completely full of marijuana.

• A vacuum sealer air pump.

• Numerous clear jewelers style baggies and large vacuum sealable baggies.

• A glass water smoking device, commonly referred to as a bong, containing marijuana.

• A bottle of butane.

• Two butane torches.

• A Honey Tip box containing pipes with residue.

• A metal grinder containing marijuana.

• A rubber container of hard candy which field tested positive for marijuana.

• Nine packages of Swisher Sweet brand cigarillos.

• A glass container believed to contain marijuana/THC oil.

• A Samsung Galaxy S7 telephone.

• A mason jar containing marijuana residue.

The residence at 1113 Barnes St. is located approximately 1,140 feet from Alva High School and approximately 750 feet from a DHS licensed daycare.

Justin Dean McClary, 23, of Alva has been charged with felonies of (1) trafficking in illegal drugs, (2) unlawful possession of controlled dangerous substance (CDS) (marijuana) with intent to distribute within 1,000 ft. of a school or daycare, (3) maintaining a dwelling for keeping and selling CDS, (4) assault and battery on a police officer, (5) assault and battery on a police office (second count), and (6) escape from arrest or detention. A warrant has been issued for his arrest.

Logan Kyle McClary, 22, of Alva has been charged with felonies of (1) trafficking in illegal drugs (bond set at $250,000), (2) maintaining a dwelling for keeping and selling controlled dangerous substances (bond set at $5,000), and (3) unlawful possession of CDS (marijuana) with intent to distribute within 1,000 ft. of school or daycare (bond set at $15,000).

Austin William Hofer, 20, of Alva has been charged with felony possession of CDS (marijuana) within 1,000 ft. of a daycare and bond was set at $5,000.

Joy Nichelle Fife, 19, of Alva has been charged with felony possession of CDS (marijuana) within 1,000 ft. of a daycare and bond was set at $5,000.
