Alva men charged with marijuana possession

Two Alva men are facing drug charges after an investigation by the Alva Police Department.

According to court records, Alva K9 Officer John Caviness developed information that Gary Lyon might be distributing marijuana from his residence in the 1000 block of 9th Street. Caviness conducted surveillance on the residence.

After suspicious activity, Caviness and Officer Keith Dale went to the apartment to speak with Lyon. At the front door, Caviness detected an overwhelming odor of burnt marijuana from the apartment. When the officers knocked on the door, they were greeted by Lyon and Johnny Briseno, known to Caviness from a past narcotic arrest. Both men denied using or possessing marijuana and denied consent to search.

Dale left to begin writing a search warrant. Caviness and Officer William Shahan secured the residence and both suspects.

When Dale returned with the signed search warrant, officers found a green oval container with a green leafy substance that Caviness identified as marijuana. They also found a blue oval container with a baggie containing a green leafy substance identified as marijuana.

In addition in the living room area in a wooden chest, Caviness located a Luther Hardware Company 410 gauge shotgun. The weapon was made safe and seized for evidence.

A criminal background check of Lyon revealed he was arrested for grand larceny in Alfalfa County and Woods County in 2013. He entered guilty pleas and is a convicted felon. In 1999 Lyon was also charged with escape from the Woods County Jail.

Gary Lowell Lyon, 45, of Alva, has been charged with possession of a firearm after former felony conviction, a felony. This crime is punishable by imprisonment for one to ten years. Lyon is also charged with possession of controlled dangerous substance (marijuana), a misdemeanor.

Johnny Charles Briseno, 48, of Alva, is also charged with possession of controlled dangerous substance (marijuana), a misdemeanor.
