Drug charges filed against Alva man

An Alva man is facing drug charges after law enforcement officers served a search warrant at his home.

Clain Brian Schultz, 45, of Alva, is charged with maintaining a place for keeping and/or selling controlled substance, a felony. This crime is punishable by a fine not more than $10,000 and/or county jail imprisonment not more than five years and costs.

Schultz is also charged with two misdemeanors: possession of controlled dangerous substance (methamphetamine) and unlawful possession of drug paraphernalia.

Court papers show when officers arrived at 1018 Fifth St. with the warrant at 1:50 p.m. on Oct. 22, Schultz was not there. The two people present said that Schultz was across the street at the University Apartments with his girlfriend.

Woods County Deputy Chase Bouziden and Alva Police Officer Kris Franta went across to the apartment where they knocked and made contact with Schultz and his girlfriend. Schultz said he had been staying at the apartment for the last three weeks instead of at the house.

Bouziden asked the two if they had anything illegal in the apartment, and both said no. When asked, they agreed to allow a search. According to the affidavit, methamphetamine and paraphernalia were found. When Bouziden took Schultz outside and read him his Miranda rights, he agreed to talk. He said he did not know anything about the meth that had been found and had not used any for some time. He also said there was no way the meth belonged to his girlfriend. Schultz did tell Bouziden that the hypodermic needles found were his. He said he liquefied his Dilaudid medication and used the needles to inject it in his nose.

Schultz said he was trying to stay away from meth, and that is why he moved in with his girlfriend. He said he knew he should stay away from the people at his residence. Schultz agreed to ride with Bouziden over to his residence.

Nicole Hough, who was at the Fifth Street residence, was placed under arrest for an outstanding Alfalfa County warrant for knowingly concealing stolen property and taken to the Woods County Jail.

At 1018 Fifth St. the officers found a large amount of used syringes and other drug paraphernalia, according to the affidavit. Undersheriff Keith Dale spoke with Schultz who said he had returned to the house to check on it over the last several weeks. He said he had been there the previous Saturday. During a search of the residence, methamphetamine, marijuana and paraphernalia were found.

Schultz was arrested and taken to the Woods County Jail. Charges were filed on Oct. 25. Also on that date, a misdemeanor charge of domestic abuse – assault and battery was filed against Schultz from an incident that occurred on Oct. 13.
