A man stopped for driving a vehicle reported stolen ended up being arrested on other charges.

According to court records, on Feb. 22 OHP Trooper Brock Morgan was on routine patrol at 10:45 p.m. when he heard Woods County dispatch broadcast a stolen vehicle that was traveling eastbound on US Highway 64. Greeley County, Kansas, deputies were tracking the vehicle remotely. The last known location was US64 and County Road 410 just west of Alva.

Morgan turned around and headed west toward Alva. The vehicle was described as a 2003 red Ford Mustang with a Kansas plate. As he approached the east edge of Alva, Morgan heard the vehicle had been tracked on US64 in Alva.

As Morgan passed by Love’s convenience store in Alva, he observed a red Ford Mustang parked at the gas pumps. He passed on by and turned around to come back. Morgan pulled into the parking lot and saw a man standing on the passenger side of the car pumping gas. He pulled in behind the Mustang and observed the Kansas license plate was a match for the stolen car.

Morgan spoke to the man and asked him to step over to his patrol unit. The man complied. He said he was headed to see his dad. He provided his Kansas driver’s license that identified him as Cody Odell Fisher.

“I guess this is about my old lady?” said Fisher. He said he and his girlfriend had been fighting, and he had left their residence in Tribune, Kansas. He said they had been together six years. He showed Morgan text messages on his phone and played a voice message for him. The messages were from his girlfriend Melissa Sue Chavez of Tribune, Kansas. Chavez is the registered owner of the Ford Mustang. Chavez had stated that if Fisher did not answer his phone, she was going to report the car stolen. Chavez had then reported the car stolen to the Greeley County, Kansas, sheriff’s office.

Morgan asked Fisher if he had any weapons on him. Fisher stated he had a gun in a bag in the back of the car but said it was not loaded. Morgan asked if he had any felony convictions, and Fisher said he did and had been to prison for them.

Trooper Morgan located a Taurus 709 slim 9mm pistol in a black sling pack in the back seat of the car. The magazine had been removed from the gun, and the gun was unloaded. The magazine contained six rounds of 9mm ammunition. Also located was a Federal Brass 9mm ammo box with three rounds of ammo.

Fisher was taken into custody for being in possession of a firearm after a felony conviction and transported to the Woods County Sheriff’s Office.

It was later discovered that the Taurus pistol had been reported stolen in Greeley County, Kansas.

It was later discovered that the red Mustang had been tagged with a Kansas plate that did not match the VIN number. The car Fisher was driving was actually a 1999 Ford Mustang instead of a 2003. The car was later deemed as communal property in Kansas and thus not stolen.

Fisher did have a felony conviction in Tulsa County for grand larceny from a person at night and was sentenced to ten years.

Cody Odell Fisher, 32, of Tribune, Kansas, has been charged in Woods County with possession of firearm after former felony conviction, a felony. This crime is punishable by imprisonment for one to ten years.

Fisher is also charged with a misdemeanor of knowingly concealing stolen property. This crime is punishable by imprisonment in the county jail not exceeding one year or by a fine not exceeding $500, or both such fine and imprisonment.
