A misdemeanor domestic assault charge had a felony added when a firearm became involved. Erica Jane Corr, 29, of Alva, has been charged with feloniously pointing a firearm. Information on the charge states Corr is charged with willfully pointing a handgun at Warren Corr for the purpose of threatening or with the intention of discharging the firearm or with any malice or for injuring, either by physical injury or mental or emotional intimidation of for purposes of whimsy, humor or prank, or in anger or otherwise and for other than a lawful purpose, including an act of self-defense. This crime is punishable by imprisonment for one to ten years.

Corr is also charged with domestic abuse – assault and battery, a misdemeanor punishable by imprisonment up to one year or a fine of $5,000, or both.

According to court documents, Alva Police Officer Sean Farris responded to a report of domestic assault and battery in progress on Monday, April 29, at 11:50 a.m. On the way he was advised the parties had separated with the man waiting in the yard and the woman inside the residence on Young Street. Farris met with Warren Corr whose shirt was ripped open from around the neck and down the right sleeve. Farris saw no visible injuries to his person.

Warren said his wife had admitted engaging in sexual activity with another man, and they were filing for divorce. Warren had been in the process of disposing of their marriage memorabilia when his wife attacked him, tearing his shirt and hitting him with her fists. Warren told Farris that Erica had pointed a handgun at him in the last week and stated, “I can fix my problems right now,” while holding the gun at him.

Farris entered the residence and spoke to Erica who said she and Warren were getting a divorce after she engaged in sexual activity with another man, according to the affidavit. Erica said Warren was tearing up and throwing away pictures of their wedding, and she was attempting to take them from his hands. When asked about the torn shirt, Erica told Farris that resulted from her trying to get the pictures from Warren. Farris asked Erica if she had physically struck Warren by punching or kicking him. According to the affidavit, Corr dropped her head and looked at the floor before nodding and answering in the affirmative that she had struck him.

Regarding the handgun, Erica told Farris she picked up the weapon at first to use on herself but ended up pointing it at Warren. Erica said she did not remember exactly what she had said to him but she did remember saying something to him when she had the gun pointed at him.
