After repeated charges of violating a protective order, an Alva man is now facing a felony stalking charge.

According to court documents, on Monday, July 29, Alva Police Officer Shahan responded to the 200 block of Santa Fe for a protective order violation. He spoke to Alyssa Kenyon who said Shaun McLelland had violated the protective order she had against him by contacting her through text messages. She said he sent her over 95 text messages from 11:54 a.m. on July 28 to 5:41 p.m. on July 29.

Shahan and Officer Kris Franta located McLelland at his residence on Second Street at 5:59 p.m. Franta asked him if he had contacted Kenyon through text message. McLelland denied having another phone or contacting Kenyon using his phone. Franta warned McLelland if he was lying he would receive another charge for obstruction. McLelland repeatedly denied having any contact with Kenyon and stated he didn’t want to go back to jail, according to the affidavit.

Franta contacted Undersheriff Keith Dale and met him at the Sheriff’s Office to attempt to locate the account information from the phone number. It was discovered the carrier was AT&T but there was no account information linked to the number. Due to the suicidal threats made through text message and the possible multiple protective order violations, AT&T was contacted, and a ping was done on the phone. The cell phone ping showed the location of the phone to be slightly east of McLelland’s address with a radius of 40 meters.

Dale and Franta went back to McLelland’s address to speak with him at 7:10 p.m. According to the affidavit, McLelland again denied having any other device he used to contact Kenyon. Dale told him the phone had been tracked back to his residence, and they would attempt to get a search warrant to the phone, or he could cooperate and get the phone for them.

McLelland then went to his bedroom and retrieved a Samsung Galaxy Note 8 from a dresser drawer. Franta asked him if he would show him the text messages to Kenyon. He opened the phone and showed Franta two messages, saying he had deleted the others he sent, according to the affidavit.

McLelland was placed under arrest and transported to the Woods County Jail where he was booked.

Kenyon made her original complaint of harassment against McLelland on June 3. A protective order was placed against McLelland by Kenyon on June 14. McLelland allegedly violated the protective order on June 15 and was arrested and charged for that violation on June 25.

On July 6, it was reported McLelland had again violated the protective order; a warrant request was prepared and given to the DA’s office but no warrant was issued until July 30 when McLelland was charged with a protective order violation, a misdemeanor.

In that case Kenyon told Franta that on July 2 McLelland followed her from Walmart to her babysitter’s house, parking around the corner and leaving after Kenyon left the residence. Kenyon reported on July 3 McLelland attempted to add Kenyon on Snapchat, but she did not respond and blocked him from her account. On July 4, he again attempted to add her on Snapchat, Kenyon said, but she again denied the request. On July 5 at midnight, Kenyon saw McLelland had taken two screen shots from her snap story. He also attempted to add her on Facebook.

In addition, Kenyon told Franta she had seen McLelland drive by her residence and her sister’s residence almost daily since the protective order had been in effect.

On July 6, Franta went to McLelland’s residence to speak to him. According to the affidavit, McLelland said he did attempt to add Kenyon on Snapchat and Facebook but did not think it was a violation of the protective order. McLelland also denied driving by Kenyon’s residence.

According to online records, when McLelland posted bond it was conditioned on his having no contact with the alleged victim of whatsoever kind and nature including telephone, texting, mail, email, Facebook, Snapchat, any other social media or electronic means, face to face contact, sending a messenger, agent or otherwise to contact alleged victim.

In addition to three misdemeanor charges of protective order violation, filed on June 25, July 30 and July 31, Shaun O’Brien McLelland, 34, of Alva, has been charged with stalking, a felony. This crime is punishable by imprisonment in the county jail for not more than one year, or by a fine of not more than $1,000, or by both such fine and imprisonment.
