McALESTER, Okla. (AP) — A southeast Oklahoma sheriff's deputy has been cleared in the fatal shooting of a 19-year-old man who authorities say was trying to pull a gun on the deputy.
The McAlester News-Capital reports that Pittsburg County District Attorney Charles Sullivan on Tuesday found the Oct. 11 shooting of Sayven Rowland by Deputy Cody Vaughn was justified.
Sullivan said an investigation shows Rowland was reaching into his pants for a weapon after twice being shot with a "pepper spray like gel" when Vaughn shot him. Rowland was pronounced dead at the scene near the town of Pittsburg, about 110 miles (177 kilometers) southeast of Oklahoma City. Sullivan said a loaded gun was found in Rowland's waistband.
Sheriff Chris Morris said the shooting occurred after Rowland crashed an all-terrain vehicle while being pursued by Vaughn and another deputy.
