Waynoka man charged with stealing pistol

A Waynoka man is facing several charges involving the theft of a firearm.

According to court documents, on Oct. 5 at 9:42 p.m. Waynoka Police Officer Adam Barlow was contacted by a Woods County deputy regarding a stolen firearm. The deputy said he was going to the 1500 block of Lincoln Street in Waynoka to speak with the reporting party about a pistol she believed may have been stolen by a Waynoka Police officer’s husband.

After speaking with Diana Derscha, the deputy met with Barlow at the Waynoka Police Department. They determined the wife of the suspect was not a police officer, and only shared the same first name which they explained to Derscha in a telephone call. The pistol’s information was entered in the NCIC.

The next day, Barlow went to Derscha’s residence and asked her to fill out a statement. While she did, Barlow spoke with her more about the incident. She stated that a week prior, both Jeffrey and Misty Montgomery, a couple she knew, came to her house, and they were visiting on her front porch. Jeffery asked if he could go inside to use the restroom. In the front room was a pool table, and on top of it was the holstered Taurus 9mm pistol she’d bought over a year ago at Atwoods in Woodward. In order to get to the restroom from the front door, one would have to pass through the living room and beside the pool table.

Derscha said after the couple left, she noticed the pistol was missing and suspected Jeffrey had taken it. She asked a neighbor to go to Jeffrey’s house and ask to buy the pistol. The neighbor, who asked to remain anonymous, confirmed to Derscha that the pistol was at Jeffrey’s house in the 1500 block of Logan, just a block west of her own. Derscha stated the neighbor took a picture of the pistol, telling Jeffrey he knew somebody who may want to buy it. Derscha said he showed that picture to her, and she confirmed it was her pistol.

Barlow returned to the police department and looked up Montgomery’s information. Through a limited records search, he found Montgomery had a felony and misdemeanor warrant out of Major County for theft-related charges, and that he was a convicted felon having convictions in Nevada, Virginia and North Carolina.

On Oct. 7, Waynoka Chief of Police Misty Smiley filed for a search warrant using the information gathered. It was approved, and approximately 4:30 that afternoon officers from the Waynoka Police Department and Woods County Sheriff’s Office served the warrant. During the search of the Montgomery residence, they located the stolen loaded Taurus 9mm pistol in the north bedroom along with a loaded Rock Island .38 caliber revolver and a Mossburg 12 gauge shotgun. Also discovered was a police scanner in the living room that was programmed for the Waynoka police frequency.

Montgomery was placed under arrest and taken to the Woods County Jail to be booked in.

Jeffrey Vernon Montgomery, 53, of Waynoka, has been charged with larceny from the house, a felony. This crime is punishable by imprisonment for up to five years.

In another filing, Montgomery is charged with three additional felony counts: (1) possession of firearm after former felony conviction, (2) unlawful use of police radio and (3) knowingly receiving or concealing stolen property. The first count is punishable for one to ten years. The second is punishable by imprisonment not exceeding three years and/or a $5,000 fine. The third is punishable by imprisonment in the state penitentiary not to exceed five years, or in the county jail not to exceed one year, or by a fine not to exceed $500 or by both such fine and imprisonment.
