Seven child porn charges filed against Alva man

An Alva man is facing seven felony charges related to child pornography after an investigation following a tip.

According to court records, on Oct. 20 District Attorney’s Investigator Steve Tanio received a National Center for Missing and Exploited Children cyber-tip in reference to the uploading and distribution of child pornography on an individual’s social media account. Tanio reviewed the Instagram upload from an account registered to Ruben Lee Bustillos, Jr. of Alva which featured an image of a pre-pubescent female in a revealing pose.

Tanio conducted a limited background check of Bustillos, locating a driver’s license with an Alva address. He located a criminal history report for Bustillos from the State of Texas for sexual contact with a child to which he pled guilty in December 1999 and received a ten-year sentence.

On Oct. 20 Tanio obtained a court order for Bustillos’ Instagram account which he emailed to Facebook, Inc., the owner of Instagram. On Dec. 28, Tanio received the results of the search warrant.

On Dec. 28, Woods County Undersheriff Keith Dale reported Bustillos was listed as an aggravated sex offender who had been registering to the Sheriff’s Office and the Oklahoma Department of Corrections on a regular basis. He last registered in early December 2020 listing his current residence as 508 Mimosa Drive.

On Dec. 29, Woods County Sheriff’s Deputies David Cummings, Kyle Fuller and Adam Honeyman, Dewey County Sheriff L. Clay Sander, Alva Police Officers John Caviness and Kaleb Keplinger, Undersheriff Dale and Investigator Tanio executed a lawfully obtained search warrant on the residence, property and vehicles of Bustillos.

During the search, Dale located a Samsung cellphone in a pickup truck driven by Bustillos. Tanio had advised Bustillos of his Miranda rights, and Bustillos waived those rights. Bustillos initially admitted to Dale there were sexually explicit images on the cellphone.

Sheriff Sander is an internet crimes against children task force member with special training in conducting forensic examinations of cellular telephones. Sander told Tanio he had located numerous sexually explicit still images and video clips of children on the cellphone belonging to Bustillos.

Tanio, Dale and Sander conducted a post-Miranda videotaped interview of Bustillos in which he admitted to obtaining all of the child pornography images found on his cellphone. He stated he knew this was wrong and was sorry for doing this.

On Dec. 30 in Woods County, Ruben Lee Bustillos, Jr., 43, of Alva, was charged with seven felonies including five counts of possession of child pornography, distribution of child pornography and violation of Oklahoma statute via computer (a cellphone is considered a computer).

Possession of child pornography is punishable by imprisonment up to 20 years or a fine up to $25,000, or both, and post-imprisonment supervision, minimum sentence provisions.

Distribution of child pornography is punishable by imprisonment up to 10 years or a fine up to $10,000, or both.
