Rape and child pornography charges have been filed in Woods County against an Alva man.

Jalin Kaine Patten, 22, of Alva, has been charged with rape – first degree (by force or fear) and with rape – second degree. Both are felonies. First degree rape is punishable by five years to life in prison. Second degree rape is punishable by imprisonment for one to 15 years.

Patten is also charged with (1) pornography – procure/produce juvenile pornography, (2) obscene material – publish juvenile pornography, (3) pornography – possess juvenile pornography, and (4) violation of Oklahoma statue via computer, all felonies.

Court documents show on Nov. 29, Alva Police Officer Timothy Clapp told District Attorney’s Investigator Steve Tanio that he had received a report of sexual assault occurring in Alva. Clapp said the victim, age 18, reported that Patten had raped her in an Alva residence during the evening hours of Nov. 23. Clapp requested assistance with his investigation.

On Nov. 29, the victim told Tanio that Patten, who was homeless at the time, was allowed to stay at her mother’s residence. The victim moved back into her mother’s residence during Thanksgiving week. She said on Nov. 23, she and Patten were watching videos on a bedroom television. She said he began putting his hands on her, and she repeatedly told him no and attempted to push his hands away. He eventually removed some of her clothing and raped her while she tried to push him off her. He then fled the residence and had not returned.

The victim said prior to the sexual assault, she had both sent and received sexually explicit images on her cellphone to and from Patten’s cellphone. She said she was 17 when she received the sexually images of Patten on her phone and sent the sexually explicit images of herself to his cellphone.

On Nov. 29, during a post-Miranda, videotaped interview, Tanio states that Patten said he had engaged in sexual intercourse with the victim on the bed of her Alva residence within the last week. Patten stated this was consensual activity, however he recalled an incident possibly Wednesday evening when she had told him no. He said he grabbed her breast even though she told him no. Patten had two cellphones that were seized by Tanio.

On Nov. 29, Tanio spoke with a second victim, age 15, who said Patten engaged in sexual intercourse with her at an Alva residence on Nov. 10-11. She said a short time after that, Patten asked her for a nude selfie. She had taken a close-up picture of her breasts and sent those to Patten’s social media account using her cellphone. She had also received sexually explicit video clips and still images of Patten on her cellphone.

On Nov. 29, Tanio conducted a limited background check of Patten. He located a Texas ID card for Patten with an address in West McLennan, Texas. He located an extensive criminal history record in the State of Texas. Prior charges consisted of aggravated sexual assault of a child, assault of family/house member/impeding breath circulation, burglary of habitation, criminal trespass and theft of property.

An arrest warrant was served on Dec. 1, and Patten’s bond has been set at $100,000. His next court appearance is Jan. 10, according to online records.
