Alva man faces child pornography charges

An Alva man is facing three felony charges involving child pornography. On Sept. 16, Dalton Zane Cunningham, 25, of Alva, was charged in Woods County with (1) procurement of child for pornography, (2) possession of juvenile pornography and (3) violation of Oklahoma statute via computer.

The first charge is punishable by imprisonment up to 20 years. The second is punishable by imprisonment for not more than 20 years or by the imposition of a fine of not more than $25,000, or by both fine and imprisonment. Persons convicted under this section shall not be eligible for a deferred sentence. The third charge is punishable by imprisonment for not more than five years or by a fine of not more than $5,000, or by both such imprisonment and fine.

Court records show District Attorney’s Investigator Steve Tanio obtained a search warrant on the residence occupied by Cunningham on Sept. 10. Tanio seized an Apple iPhone which Cunningham located and identified as the cellular device he had been using recently.


On Sept. 11, Tanio obtained a search warrant for the cellphone. While reviewing the digital evidence, he observed sexually explicit images of a 16-year-old female whom Tanio had previously investigated as a victim regarding child abuse cases. The digital data associated with one of the images indicated it was created on the phone on 09-04-19. In addition, Tanio observed sexually explicit images of another female, who he believed was underage.

On Sept. 16 Tanio conducted a videotaped interview of the 16-year-old juvenile female. She told him she knew Cunningham, and he had been texting her on Facebook Messenger for the past two years. When Cunningham first began communicating with her, he told her he was in his twenties and asked how old she was. She said she replied she was in her teens.


She told Tanio that Cunningham had repeatedly asked her to send nude images of herself to him through his cellular telephone. According to the affidavit, the juvenile identified the sexually explicit image of herself which was recovered from Cunningham’s cellphone as one of two images of herself she sent to him. She told Tanio that Cunningham had requested she come to his residence for sexual activity, however she did not.

The girl told Tanio she had used her Apple iPhone to communicate with Cunningham and to take and send the explicit images of herself to Cunningham’s phone. Tanio took custody of her cellphone.

Cunningham’s bond was set at $15,000 on each of the three counts with the provision that he have no contact of any nature with any juvenile female not a family member. His next court date is Oct. 8.
