Three Cherokee residents charged with fraudulent use of credit card

Three Cherokee residents are facing misdemeanor charges in Alfalfa County after allegedly using a credit card without the cardholder’s consent.

Court records show on Wednesday, Jan. 10, John Patton of Cherokee spoke with Cherokee Police Chief Ryan McNeil regarding the unauthorized use of his credit card as well as the theft of approximately $200 in coins. Patton identified a possible suspect as Lavada Lynn Frye who did odd jobs for him such as cleaning his house. He stated she would have had access to the credit card and to the coins.

Patton stated he last used the Chase Freedom credit card while shopping in Enid at or around Nov. 30, 2023. He said he received the monthly statement for the card and observed there were numerous charges he did not make at numerous local businesses, both in Cherokee and Enid.

One of the businesses was the Jiffy Trip gas station in Cherokee where the card was used on three different occasions. McNeil spoke with the manager who was able to locate video of the sales.

On Dec. 21 at approximately 6:23 p.m. the credit card was used to purchase 8.958 gallons of gasoline for a total of $30. The suspect using the credit card was a female with blond hair wearing a pink t-shirt. McNeil recognized her as Rhonda Harris, the sister of Frye.

On Dec. 23 at approximately 12:55 a.m. the credit card was used to purchase 14.82 gallons of gasoline, a 20 oz. Mountain Dew and a 1.85 oz. Zero for a total of $47.32. The suspect observed using the card was a female with blond hair wearing a black and white shirt or jacket over a pink t-shirt. McNeil recognized the woman as Lavada Frye.

On Dec. 24 at approximately 2:30 p.m. the credit card was used to purchase 12.504 gallons of gasoline for a total of $40. The suspect observed using the card was a male with short hair wearing a blue hooded sweatshirt with a red design on the front. McNeil did not recognize the man, but the manager stated he was named Kevin and was the son of Frye. McNeil was aware that Frye has a son named Kevin Gillispie.

McNeil checked with two other businesses, United Supermarket and Dollar General in Cherokee. He learned the credit card was used by Patton at United Supermarket on Dec. 19. Dollar General was not able to provide any video.

Additional charges were made to the credit card in Alva, Jet, Enid and in Wichita, Kansas, but McNeil was unable to check those locations for video. The total amount of alleged fraudulent charges was calculated to be $1,246.49.

Lavada Lynn Frye, 56; Rhonda Marie Harris alias: Rhonda Nelson, 51; and Kevin E. Gillespie, 33, all of Cherokee, have each been charged with use of forged or revoked credit card, a misdemeanor.
