Drug arrest results from traffic stop

A traffic stop last weekend in Alva landed the driver in jail on a marijuana charge. Kobee Lane Barnett, 18, of Alva has been charged with distribution of controlled dangerous substance – including possession with intent to distribute, a felony. This crime is punishable by imprisonment for two years to life or a fine of up to $20,000, or both imprisonment and fine.

According to court documents, on Sunday, Nov. 26, at about 2:55 p.m. Woods County Undersheriff Keith Dale saw a brown Ford F-150 traveling northbound on Second Street at more than the posted speed of 25 mph. He checked the pickup’s speed by radar which showed it traveling at 38 mph.

Dale conducted a traffic stop and made contact with the driver, Kobee Lane Barnett, at the driver’s door. While speaking with Barnett, Dale states he could smell the overwhelming odor of marijuana emitting from the vehicle. He obtained Barnett’s driver’s license in addition to identification from Barnett’s front seat passenger, a 17 year old juvenile male.


Dale states after instructing both occupants to exit the vehicle, he patted them down for weapons. He felt a metal object in the juvenile’s front pocket and asked what it was. The juvenile told him it was a “one-hitter,” removed it and handed it to Dale. When Dale examined the pipe, he found it contained marijuana residue.

A search of the vehicle revealed a bible with marijuana on it, four empty packages of various cigars (which are commonly used to smoke marijuana), three packages of various cigars, a metal grinder containing marijuana, a metal tin containing loose marijuana, a green plastic West Edison Cannabis Concentrate container with marijuana, a prescription pill bottle prescribed to Kobee Barnett containing the odor of marijuana, a Nitro XL bottle containing the odor of marijuana, a piece of metal with marijuana residue on it, a digital scale with residue on it and one ten dollar bill inside, a glass pipe containing marijuana, a KangerTech RBA plastic baggie containing marijuana.


Both Barnett and the juvenile were placed under arrest and transported to the Woods County Sheriff’s Office.

Undersheriff Dale conducted a post-Miranda Rights interview with the juvenile and his father. During the interview the juvenile told Dale that Barnett picked him up at his residence earlier in the day to give him a ride to a friend’s house. According to the affidavit, the juvenile said while they were driving Barnett provided him marijuana to smoke from the glass pipe. The juvenile and his father completed a Juvenile Promise to Appear form and were released.


Dale then conducted a post-Miranda Rights interview with Barnett who said he makes frequent trips to Colorado where he purchases marijuana and brings it back to Kansas and Oklahoma. During the interview he allegedly told Dale that he provided the marijuana to the juvenile to smoke.

Barnett’s bond has been set at $10,000, and his next court appearance is Jan. 9, 2018.
