Alva man faces second felony drug charge

In November 2016 Alva Police Officer John Caviness was contacted by neighbors about heavy vehicle and foot traffic at all hours coming and going at 204 Santa Fe. Caviness was familiar with the address and the resident, Kyle Preston Smith, from previous encounters including a search warrant served in 2015.

After the report, Caviness conducted surveillance of the address, observing a large volume of traffic at all hours. He also noted that many of the vehicles he saw were registered to people having current or past history of illegal narcotic usage. Caviness also interviewed several people about drug activity at that address.

According to court documents, on Dec. 29 about noon law enforcement officers from the Alva Police Department, Woods County Sheriff’s Office and the Oklahoma Highway Patrol executed a search warrant at 204 Santa Fe in Alva. Smith was not home at the time of entry.

During the search a black glasses case was found in the bedroom area. Inside were four clear jewelry baggies containing a white powder that field tested positive for methamphetamine. Also located were a smoking pipe with white residue, a cut straw, a cut ink pen and a digital scale.

Smith arrived at his residence and was detained for possession of controlled substance within 1,000 feet of a school. The residence is less than 75 feet from Alva Public School property.

Caviness noted that this is the second time in a year and a half that a search warrant has been executed on Smith’s residence. In both incidents illegal narcotics were found.

According to the court file, Smith is set to take a plea deal on criminal case CF-2015-00104 possession of controlled dangerous substance 1,000 feet from a school and possession of firearm in commission of a felony. That court appearance is set for Feb. 8, 2017, at 10 a.m.

A felony charge of possession of controlled substance (methamphetamine) within 1,000 feet of a school was filed against Kyle Preston Smith, 55, of Alva on Jan. 18, 2017. This crime is punishable by imprisonment for four to 20 years and a fine of not more than $10,000. Smith’s bond on this charge was set at $15,000. He has posted bond and his next court appearance on this charge is set for Feb. 14.
