Cherokee man arrested after domestic altercation

 


A Cherokee man has been charged with domestic assault and battery after another man was injured. According to court records, on May 27 about 12:24 a.m. Cherokee Police Officer William Irvin was contacted by the Alfalfa County Sheriff’s Department and was told he was needed at 113 W. Sixth St. where Charles Garner had fallen through a window and had some large cuts on his neck.

When he arrived, Irvin saw Curtis Kimminau sitting on the porch of the residence. Alfalfa County Deputy TJ Rockenbach was inside assisting Garner who was sitting on the side of his bed.

Just a few minutes later, Greg Graham with EMS arrived and bandaged Garner’s neck. Graham informed Garner he needed stitches and needed to be transported to the hospital. Garner said he couldn’t afford to be taken by ambulance and wanted his mother and his financial advisor, both from Enid, to take him.

Irvin offered to take Garner in his patrol car and it wouldn’t cost him anything, but Garner refused, saying he was going to call his mother. He reached his mother, who agreed to come and take him to the hospital.

About 12:40 a.m. Helena EMS arrived and evaluated Garner. They also informed Garner he needed to be taken to the hospital. He refused their service and told them his mother was going to take him. Helena EMS had Garner sign a waiver of treatment and left the scene.

About 1:50 a.m. Garner contacted his mother again by phone and allowed Irvin to make arrangements to meet them in Nash. Irvin instructed Kimminau to stay at the residence so he could come back and talk with him. He then drove Garner to Nash.

On the way to Nash, Irvin asked Garner what took place between him and Kimminau. Garner said he checked Kimminau’s phone and found he had been talking to other men. Garner said he informed Kimminau their relationship was over and that he also had interest in another man. Garner said he tried to leave the residence through the back door in the kitchen area and was stopped by Kimminau, who refused to let him leave. He said they began to push and shove each other. Garner said Kimminau pushed him during the incident and that he lost his balance and fell partly through the west dining room window. Irvin observed three cuts on the right side of Garner’s neck and shoulder. The cuts appeared to be about a half inch deep, two to six inches in length and were opened approximately one to one and one-half inches.

When Officer Irvin returned to the residence, Kimminau said Garner had checked his phone a couple of days prior and they had been arguing over what was on the phone for about two days. He said Garner was very jealous of him. He said Garner tried to leave the house through the back door and he stopped him. He said they were pushing each other to the point he fell and hit the right side of his head on the counter top, and Garner fell into the back door causing the window to partially break. Irvin observed an inch-long scratch on Kimminau’s left cheek, bruising on the upper part of his left arm and about a three-inch knot on the right upper part of his head.

Both men told Irvin they had been drinking and shared one pint of tequila.

Irvin assessed damage to the house, finding the west window broken completely out with the glass all on the outside on the ground. The dining table looked like it had been shoved away from in front of the broken window. There were two spots of blood on the window blinds of the broken window and a few drops of blood on a rug in the center of the floor. The back door window was shattered with one small piece broken completely out.

Kimminau was placed under arrest and transported to the Alfalfa County Jail. At the jail, Kimminau informed Irvin and the jailer that he was going to kill himself. He was taken to St. Mary’s Hospital in Enid for evaluation and later admitted to Northwest Center Behavioral Hospital in Fort Supply.

Curtis William Kimminau, 37, of Cherokee has been charged with domestic abuse – assault and battery, a misdemeanor.
