Aline man faces drug charges

 


An Aline man is facing two felony drug charges following a traffic stop in Alfalfa County.

Colton Ray Cheshire, 19, of Aline is charged with maintaining a place for keeping and/or selling controlled substance and with distribution of controlled dangerous substance – including possession with intent to distribute. The first charge is punishable by a fine not more than $10,000 and/or county jail imprisonment not more than five years and costs. The second is punishable by imprisonment for two years to life and/or a fine of up to $20,000. Cheshire is also charged with a misdemeanor of unlawful possession of drug paraphernalia.

According to court documents, Alfalfa County Deputy Thomas Wilson stopped Cheshire on March 14 about 11:30 p.m. for failure to yield the right of way on Canadian Road at the Highway 8 intersection. While both were seated in the deputy’s patrol vehicle, Wilson noted a strong odor of marijuana coming from Cheshire’s person. Wilson described Cheshire as very nervous with hands shaking. When asked about the odor, Cheshire said he had been around some people smoking marijuana but he didn’t smoke. He refused permission to have his vehicle searched. Wilson said he was going to have a K-9 come out and if there was anything in the vehicle or on him, the K-9 would find it.

At that point Cheshire said, “I have a little on me,” according to the affidavit. The K-9 was walked around the vehicle and gave a positive alert. In searching the vehicle, Wilson found a bag of a green leafy substance with a gross weight of 7.9 grams. Found on Cheshire was a small wooden case containing another clear bag with 4.0 grams of a green leafy substance. A digital scare was also found in the front seat of the vehicle.

According to the affidavit, Cheshire admitted to trying to make some extra money by selling the marijuana because he wasn’t in a good financial situation. He was placed under arrest
